Confirmation of the order by the customer implies full and complete acceptance of these general conditions as well as the general conditions of use validated beforehand, without restriction or reservation.

Article 1: SCOPE

The offers presented on the site https://cornershop.immersion.fr/ (software, products) are intended for professionals. The fact that the customer places an order materializes his commitment to use the product (s) ordered only in a professional context, and for his own needs, without possible concession to one or more third parties, even free of charge.

Article 2: PRICE AND ORDER

The software and products offered on the site https://cornershop.immersion.fr/ are sold at the prices in force on the day of the order confirmation in euros, all taxes included, excluding any delivery costs. Prices can be changed unilaterally without prior notice. The fact that the customer places an order materializes his acceptance of said prices. It is recalled that the customer must ensure that the product ordered is in line with the objectives he has set for himself. The customer can in no way hold the seller responsible, in the case of a delivery in accordance with his order but not in accordance with his needs. Orders sent to the site https://cornershop.immersion.fr/ are irrevocable for the Customer upon validation of payment by IMMERSION. Any request to modify the composition or volume of an order placed by a Customer can only be taken into account if the order has not yet been processed by our computer system and if the request is made in writing (email to the following address cornershop@immersion.fr or to your usual advisor) and confirmed by our services. It is expressly provided that the company IMMERSION may refuse a sale that is abnormal or that contravenes the general conditions of use previously accepted by the customer, even after receipt of the amount of the order. In this case, IMMERSION will reimburse the customer for the amount of his order within thirty days without the latter being able to claim additional damages for the damage suffered as a result of the cancellation of his order.

Article 3: PAYMENT

The sale is subject to full payment of the order by the customer. It will only be effective after verification by IMMERSION of the receipt of funds in its bank account. Several payment methods are accepted by IMMERSION:

  • Online payment via the secure payment system Paypal
  • Payment by bank transfer to the Seller’s bank account (the details of which are communicated to the Customer when placing the order)

It is to highlight that :

  • partial payment does not allow partial execution of the order

Article 4: GUARANTEE AND LIMITATIONS OF LIABILITY

The guarantees applied to the products ordered are those in force at the manufacturer (s) or publisher (s) of said products. More generally, the products delivered by IMMERSION are guaranteed against any manufacturing defect. The presentation of the guarantee certificate will be strictly required when the guarantee is invoked. Under these guarantees, the only obligation incumbent on the seller will be to ensure the free replacement or repair of the product or element recognized as defective, unless this method of compensation proves to be impossible or disproportionate. To benefit from the warranty, any product must first be submitted to the seller’s after-sales service, whose agreement is essential for any replacement. Any shipping costs are the responsibility of the Customer. It is the Customer’s responsibility to inquire about the maintenance and warranty conditions for the product ordered. Any complaint in this regard must be sent to IMMERSION by registered letter with acknowledgment of receipt to the following address: IMMERSION SA CornerShop Complaints Department 3-5 rue Raymond Lavigne, 33100 BORDEAUX addressed to IMMERSION’s liability is excluded within following cases: – non-compliant or illegal use of the products by the Customer; – normal wear and tear of the products; – deterioration of products or accidents resulting from a lack of maintenance, and in particular breakage, breakage, humidity, inadequate temperature, oxidation, liquid infiltration; – products repaired by the Customer or by third parties not approved by IMMERSION; – transformation of the product or incompatibility with other materials.

Article 5: DELIVERY / TRANSPORT

The IMMERSION company offers its customers the delivery of its products in France at variable rates depending on the quantity of products ordered. Delivery costs are automatically calculated when ordering and are indicated to the customer before he confirms his order. Consequently, as soon as the customer has validated his order, he is considered to have accepted the delivery costs. The risks and dangers of transport (in particular loss, deterioration or theft) are the responsibility of the Customer. It is up to the Customer, in the event of damaged or missing goods, to make all the necessary reservations with the carrier. Any product that has not been the subject of reservations on the transport documents and justified protests by registered letter with return receipt within 3 days of its receipt from the carrier, in accordance with article L. 133-3 of Commercial Code, a copy of which will be sent simultaneously to IMMERSION, will be considered as accepted by the Customer. IMMERSION’s responsibility cannot be blamed for facts during transport, destruction, damage, loss or theft, even if it has chosen the carrier. Delivery times are indicative and informative; They depend in particular on availability from our suppliers and carriers. IMMERSION strives to meet the delivery times indicated according to the reference logistics time in the profession. Even in the event of written acceptance of firm deadlines, IMMERSION is automatically released from any commitment relating to deadlines in the following cases: technical contingencies, supplier failure, out of stock, carrier failure, force majeure, fortuitous event, inaccuracy or lack of information to be provided by the Customer, delay deferred at the Customer’s request, absence of payment or incomplete payment, delays related to customs formalities. If https://cornershop.immersion.fr/ is unable to provide the product ordered, we will notify you and we will offer you the delivery of an equivalent product or a credit note of the value of the unavailable product. It is the customer’s responsibility to ensure that the delivery address he has communicated to IMMERSION is correct and that the products delivered comply with his order. Without prejudice to the arrangements to be made vis-à-vis the carrier, if the customer notices an error in the order or the defect of one or more of the products delivered, he must:

  • Make a reservation on the delivery note

Article 6: LEGAL INFORMATION

In the absence of an amicable resolution of the dispute, the competent court will be that of the place of the registered office of the company IMMERSION.
